Mislabeled.com is an online
social networking service that enables people to create online profiles
in order to communicate with others. The service offered by Mislabeled.com
(collectively, "Mislabeled", “us”, "we" or “the
Company”) include the Mislabeled Web Site (the "Site"),
and any other features, content, or applications offered over time by
Mislabeled in connection with the Site (collectively, the "Service").
The Mislabeled Service is hosted in the U.S. To find out more about

The following documentation
embodies the Mislabeled privacy policy ("Privacy Policy").
The Mislabeled Privacy Policy only governs information collected on
Mislabeled.com. Mislabeled understands the importance of providing users
of the Service with protection of their personal data. As a result,
Mislabeled has created a platform providing and enabling an unprecedented
level of control over user personal data. The Service allows for
some level of personal data to be viewed and shared with other people
using the Service. This is the nature of “social networking”
websites like Mislabeled.com. This Privacy Policy defines how information
collected through the Site is treated by the Company

Privacy Policy frequently, as it may be changed or updated at any time,
without notice. Any changes to this Privacy Policy will be effective
immediately upon the posting of the revised Privacy Policy on the Mislabeled.com
website. Your use of Mislabeled.com is subject to the terms of the Mislabeled
Terms of Use ("Terms of Use") and, if applicable, the terms
of any other user agreement or terms of use which Mislabeled may put
into effect over time ("Additional Agreement(s)"). By using
Mislabeled.com in any way, you represent that you understand and agree
to the terms of this Privacy Policy.
- THE
INFORMATION WE COLLECT AND HOW IT’S USED
- Use of User Submitted
Information:
- As an integral part
of the Service, Mislabeled.com collects User Submitted Information.
In many cases, this information can be classified as “Personally Identifiable
Information” that provides the Company with the ability to verify
the authenticity of a given user as well as contact users when deemed
necessary by the Company. Such information includes but is not
limited to name, age, and email address.
- Other types of User
Submitted Information are used to facilitate the communication between
a plurality of users. Again, this is the nature of an online social
networking service. Some of this information is used automatically
by the Service to allow users to communicate more efficiently.
The information that is automatically used includes, but is not limited
to, pictures and screen name (“user name”). Some User Submitted
Information is used and/or shared by the Service to create visual linkages
between other users with similar User Submitted Information. The
extent that this type of information can be used and/or shared in many
cases is based on the preference of the owner of said information.
The information that is shared and/or used based upon user preference
includes, but is not limited to, first name, geographic location, and
interests.
- Mislabeled.com is
a cost-free Service to users. To provide users with this Service,
Mislabeled provides advertising partners the ability to submit advertisements
to the Company to be displayed to users of the Service. To this
end, Mislabeled will only share User Submitted Information with trusted
third parties to the extent that such information does not identify
the user personally. For example, geographic region and age may
be used and/or shared with trusted third parties in order increase ad
efficiency and to provide users with a more meaningful and applicable
browsing experience as it relates to advertising. At no time will
a user’s name, email address, or billing information be shared with
a third party.
- There will be times
when Mislabeled will use Personally Identifiable Information for internal
purposes. For instance, users will be required to provide the Company
with specific information in order to use specific tools on Mislabeled.com
or to participate in special promotions or offerings that the Company
may create. For example, if a user wishes purchase any product via download
or delivery, the user will be asked to provide his or her credit/debit
card and billing information. Additional instances where Mislabeled
will internally utilize said information include (a) sending users Mislabeled
e-mails of any kind, such as new feature notifications or upcoming events
(b) to resolve disputes, problems, and enforce the Mislabeled Terms
of Use and any applicable Additional Agreement(s), (c) to respond to
questions or issues, (d) any additional terms and conditions applicable
to a particular feature of the Mislabeled.com, (e) as otherwise disclosed
at the point where such information is collected, and (f) in accordance
with the terms of this Privacy Policy.
- In many cases users
may willingly submit or post information to any portion or application
on Mislabeled.com, or another public forum, where that information can
be accessed by the public and can in turn be used by others to send
unsolicited communications. Mislabeled is not responsible for the personally
identifiable information users choose to submit on Mislabeled.com.
- Users may choose
not to receive any e-mail or other communications from Mislabeled by
following the removal instructions in the particular communication you
receive, or by sending an e-mail to opt-out to privacy@Mislabeled.com
with only the words "opt out" in the subject line.
- Use of Non-personally
Identifiable Information:
- Mislabeled will
collect non-personally-identifiable information from users automatically
through servers used by the Company. This information includes, but
is not limited to, user data and usage patterns, web browser types and
versions, and IP addresses. Usage by Mislabeled of this type of data
enables the Company to perform standard operations including, but is
not limited to, studying usage patterns, gathering demographic information
about users, administrating and improving the Service, and authenticating
contests. This non-personally identifiable information may be aggregated
and shared with trusted third parties for advertising or other purposes.
This information will never personally identify the user.
- Mislabeled reserves
the right to disclose any user information, be it personally identifiable
or non-personally identifiable information, if the Company is required
to do so by law or if the Company reasonably believes that such action
is necessary in order to: (a) fulfill a government request; (b) conform
with the requirements of the law or to comply with legal process served
on us; (c) to protect or defend our legal rights or property, the Site,
or its users; or (d) in an emergency to protect the health and safety
of the Site's users or the general public.
- Policy for Underage
Minors
- Mislabeled does
not permit registration by, and will not knowingly collect or use personally
identifiable information from, anyone less than 13 years of age. In
the event that the Company becomes aware of a minor under the age of
13 using the Service in any capacity, we will make reasonable efforts
to delete such person’s account from the Service. The Company will
not knowingly allow children under the age of 13 to maintain use of
the Service, or maintain and/or use user data of minors under the age
of 13.
- Use of Cookies
- Mislabeled stores
specific information from users’ browsers using "cookies",
or parcels of text sent by the Company server to the browser and back.
Cookies are used to store visitors' preferences and to record session
information, and to authenticate, track, and maintain such preferences
and information. Mislabeled employs session ID cookies to confirm
that users are logged in; however, these cookies terminate once the
user closes the browser. It is a standard industry practice to use a
persistent cookie that stores each user’s login ID to make it easier
for returning users to log in. Mislabeled uses this practice.
Web browsers should have the ability to be configured to accept or reject
all or some cookies, or notify you when a cookie is set. Be advised
that cookies must be enabled from Mislabeled.com in order to use many
functions on the Mislabeled.com.
- SECURITY
- Methods
- To become a registered
user of the Service, an account password is required. This password
serves as a layer of security and protection over user information.
For this reason, it is important that such user-created passwords remain
undisclosed to any other person. Password protection as well as any
and all activities that occur under that password or account are the
sole responsibility of the user. Mislabeled employs reasonable and responsible
methods for protecting private information that is stored on Mislabeled.com
or on the Company servers against unauthorized access and disclosure.
Mislabeled only allows access to such private information by those employees
who need access to perform their job functions, such as Mislabeled technology
and customer service staff. Mislabeled does not, however, guarantee
the security of any information disclosed or transmitted to the Company
online and cannot be responsible for the theft, destruction or inadvertent
disclosure of user personally identifiable information. User
features for changing and updating security settings can be found on
the Mislabeled.com ‘Account Settings’ portion of the user post-login
Profile page.
- Limitations
- Mislabeled.com may
contain links to third party websites that Mislabeled does not own or
maintain. Mislabeled is not responsible for the privacy policies and/or
practices on these third party websites. The Mislabeled Privacy Policy
only governs information collected on the Site.
